Welcome to PointWiseSystem. By accessing or using our service, you agree to be bound by these Terms of Service. Please read them carefully.
1. Acceptance of Terms
By creating an account and using PointWiseSystem ("the Service"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of Service
PointWiseSystem is a web-based application that helps families, homeschools, classrooms, teams, and organizations track positive actions and behaviors through a point-based reward system. The Service allows users to:
- Create and manage earner profiles
- Award points for completing tasks and positive actions
- Define and track rewards
- Create custom tasks, rewards, routines, and goals
- Use Hub features (wishlists, care cards, shopping lists, meal plans)
- View activity history, analytics, and insights
- Receive SMS notifications (opt-in)
3. Account Registration
3.1 Account Creation
To use the Service, you must create an account by providing a valid email address and password, or by authenticating via Google OAuth. You are responsible for maintaining the confidentiality of your account credentials.
3.2 Account Security
You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3.3 Administrative Access
You acknowledge and agree that our authorized administrators may access your account for the following purposes:
- Providing customer support and troubleshooting issues you report
- Investigating and resolving support tickets
- Ensuring service quality and proper functionality
- Detecting and preventing fraud, abuse, or violations of these Terms
Such access is limited to authorized personnel, logged for accountability, and conducted in accordance with our Privacy Policy.
3.4 Co-Admin Access
Account owners may invite co-administrators to help manage their account. Co-admins share access to the account owner's earner data and features based on the owner's subscription tier. Account owners are responsible for the actions of their co-admins.
Disputes and Account Changes: In the event of disputes between account owners and co-admins, including but not limited to divorce, separation, custody disputes, or estate matters, PointWiseSystem reserves the right to suspend account access pending resolution, or to act based on documented legal authority. Account ownership cannot be transferred between users without documented authorization. In the event of an account owner's death or incapacitation, designated co-admins may request continued access by contacting support@pointwisesystem.com; we may require court documentation for full account ownership transfer.
3.5 Age Requirements
You must be at least 18 years old to create an account. The Service is designed for adults to manage point systems for earners (children, students, team members, etc.).
4. Subscription Plans and Pricing
4.1 Free Plan
The Free plan includes:
- Up to 2 earners
- Pre-made tasks and rewards (cannot create custom)
- 3 daily recurring tasks per earner
- 1 routine per earner
- Last 3 days of activity history
- Basic tracking (Simple Mode)
4.2 Plus Plan
The Plus plan ($4.99/month or $49.99/year) includes:
- Unlimited earners
- Custom tasks, rewards, routines, and goals
- Unlimited activity history
- Insights and Analytics (streaks, top tasks, weekly comparison)
- Hub features (wishlists, care cards, shopping lists, meal plans)
- Custom badges and personalization
- Recurring tasks and allowance
- Co-admin access (invite others to manage)
- Parent Approval (opt-in per task)
- SMS notifications (opt-in)
- Priority email support
4.3 Homeschool Plus Plan
The Homeschool Plus plan ($7.98/month or $79.99/year) includes everything in Plus, plus:
- Homeschool Manager addon (curriculum tracking, attendance, grading)
4.4 Add-Ons
Existing Plus subscribers may purchase add-on features separately. Add-on pricing and availability may change. Current add-ons are listed on the upgrade page.
4.5 Free Trial
New accounts may receive a free trial of Plus features. The duration and availability of free trials may vary based on promotional offers. After the trial ends, your account automatically converts to the Free plan unless you subscribe.
4.6 Billing
Paid subscriptions are billed monthly or annually in advance. Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
Payment processing is provided by Stripe, Inc. By providing payment information, you also agree to Stripe's Terms of Service (https://stripe.com/legal) and Privacy Policy (https://stripe.com/privacy).
4.7 Price Changes
We reserve the right to change subscription prices. We will provide at least 30 days' notice before any price increase takes effect for existing subscribers.
4.8 Cancellation and Refunds
You may cancel your subscription at any time from your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial months or years. Upon cancellation, your account will revert to the Free plan and features beyond Free plan limits will become inaccessible (but your data will be retained).
4.9 Promotional Codes
We may offer promotional discount codes from time to time. Promo codes are subject to specific terms, expiration dates, and eligibility requirements. Promo codes cannot be combined, transferred, or redeemed for cash.
5. User Content and Data
5.1 Your Data
You retain all rights to the data you enter into the Service (earner names, tasks, rewards, hub content, etc.). We do not claim ownership of your content.
5.2 License to Use
By using the Service, you grant us a limited license to store, process, and display your data solely for the purpose of providing the Service to you.
5.3 Data Storage
We store your data securely on AWS servers in the United States. We implement industry-standard security measures to protect your information.
5.4 Data Deletion
You may delete your account at any time from the settings page. Upon deletion, your data will be permanently removed from our systems within 30 days. Payment records may be retained longer as required by law.
5.5 Data Portability
You may request an export of your data by contacting us at support@pointwisesystem.com.
6. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or its infrastructure
- Upload malicious code, viruses, or harmful content
- Harass, abuse, or harm others through the Service
- Use the Service to collect data about other users without consent
- Circumvent or attempt to circumvent subscription limits or access controls
- Use automated tools (bots, scrapers) to access the Service without permission
- Violate any applicable laws or regulations
7. SMS Communications (TCPA)
By opting in to SMS notifications from PointWiseSystem, you provide prior express written consent under the Telephone Consumer Protection Act (TCPA) to receive SMS text messages from PointWiseSystem at the phone number you provide. This consent includes messages sent using an automatic telephone dialing system (ATDS) or pre-recorded voice.
Important TCPA disclosures:
- Consent is not a condition of purchase or service. You can use PointWiseSystem without opting in to SMS.
- Message frequency: Varies based on your notification settings. Typically 1-7 messages per week per active earner.
- Message and data rates may apply based on your carrier and mobile plan.
- To opt out: Reply STOP to any message. You will receive one final confirmation message and no further messages thereafter.
- For help: Reply HELP to any message, or contact support@pointwisesystem.com.
- Provider: SMS messages are sent via Twilio (https://www.twilio.com).
- Privacy: Your phone number and message content are subject to our Privacy Policy.
If you change your phone number or transfer ownership, you must update your account or opt out to prevent unintended message delivery.
8. Intellectual Property
The Service, including its design, features, functionality, code, and content, is owned by Denecke Media LLC and is protected by copyright, trademark, and other intellectual property laws.
8.1 Trademarks
PointWiseSystem™ is a trademark of Denecke Media LLC. You may not use our trademarks without prior written permission. All other trademarks, service marks, and trade names referenced in the Service are the property of their respective owners.
8.2 Feedback
If you provide feedback, suggestions, or ideas about the Service, you grant us a non-exclusive, royalty-free, perpetual license to use that feedback to improve the Service.
9. Third-Party Services
The Service integrates with third-party services (Stripe, Google, Twilio, etc.). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE MAKE NO WARRANTIES REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT OR FEATURES.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DENECKE MEDIA LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:
- Your use of or inability to use the Service
- Any unauthorized access to or use of our servers or your data
- Any interruption or cessation of the Service
- Any bugs, viruses, or similar issues transmitted through the Service
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify and hold harmless Denecke Media LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service or violation of these Terms.
13. Modifications to Service
We may modify, update, suspend, or discontinue the Service (or any part of it) at any time. We will provide reasonable notice for material changes that affect your use of the Service. We are not liable for any modification, suspension, or discontinuation of the Service.
14. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of significant changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending you an email notification (for material changes)
Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.
15. Termination
15.1 By You
You may terminate your account at any time by deleting it from the settings page or contacting us.
15.2 By Us
We may suspend or terminate your account for:
- Violation of these Terms or our Acceptable Use policy
- Fraudulent or abusive behavior
- Non-payment of subscription fees
- Unlawful use of the Service
- Creating risk or legal exposure for Denecke Media LLC or its users
- Discontinuation of the Service in your jurisdiction
- Other reasons we explain to you with reasonable notice (typically at least 14 days)
15.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy. Sections that by their nature should survive termination (Limitation of Liability, Indemnification, Governing Law) will survive.
16. Dispute Resolution
16.1 Informal Resolution
Before filing any formal dispute, you agree to contact us at support@pointwisesystem.com and attempt to resolve the dispute informally for at least 30 days.
16.2 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law provisions.
16.3 Jurisdiction
Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in Texas. You consent to the personal jurisdiction of these courts.
17. General Provisions
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Denecke Media LLC regarding the Service.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
17.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
17.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
